Rights of Persons with regard to Personal Data

The Person who provides their Personal Data has the right to:

  • Obtain information concerning the rights regarding Personal Data
  • Withdraw consent without notice for processing of Personal Data without affecting the lawfulness of the processing based on consent before its withdrawal

Purposes of processing Personal Data

Personal Data may be processed for one or more of the following:

  • To provide the Person with information concerning the Services and rules of operation of ajConsulting, based on the legitimate interest of the Administrator, which is a contractual requirement.
  • To provide the Person with information regarding recruitment projects conducted by ajConsulting, tailored to the expectations, preferences and competences of the Person on the basis of the Consent, which is a contractual requirement
  • To invite individuals to participate in a tailored recruitment project conducted by ajConsulting, based on the Consent, which is a contractual requirement.
  • To perform the Agreement, on the basis of the concluded Agreement, which is a contractual and statutory requirement
  • To conclude the Agreement or to request the Personal Data from the data subject before the agreement is concluded, which is a contractual requirement, a statutory requirement and a condition for concluding the Agreement
  • To obtain information about offered services or products from persons running or representing a business activity, on the basis of the Administrator's legitimate interests, in the event of a desire to use these services or products, which is a contractual or statutory requirement or a condition for concluding an Agreement
  • To recruit associates on the basis of the Administrator’s legitimate interests or the Consent, which is a contractual requirement and a condition for concluding the Agreement
  • To employ associates on the basis of the Consent and legal obligations of the Administrator, which is a contractual requirement and statutory requirement and a condition for concluding the Agreement
  • To fulfil legal obligations, based on the Administrator’s legitimate interests and the legal obligation of the Administrator, which is a statutory requirement
  • To exercise claims or defend against claims, based on the Administrator’s legitimate interests or the legal obligation of the Administrator, which is a contractual or statutory requirement or a condition for concluding the Agreement

The processing of Personal Data on the basis of the Consent requires separate consent for each purpose of processing.

Legal basis for the processing of Personal Data

Legal basis for the processing of Personal Data is the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), including:

Article 6 (1) lit. a
"the data subject has given consent to the processing of his or her personal data for one or more specific purposes"

Article 6 (1) lit. b
"processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract"

Article 6 (1) lit. c
"processing is necessary for compliance with a legal obligation to which the controller is subject"

Article 6 (1) lit. f
"processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child"

and legal acts applicable in Poland and the European Economic Area.

Legitimate interests of the Administrator

The legitimate interests pursued by the Administrator result from the Administrator's conducting business activities, which include offering Services, performing Services, obtaining information about services or products existing on the market, recruiting associates, employing associates, fulfilling legal obligations and pursuing claims and defending against claims.

Consequences of not providing Personal Data

Failure to provide Personal Data necessary to achieve a specific goal may result in the inability to achieve this goal, including the lack of access to information about the Services, the inability to use the Services, the inability to conclude the Agreement or its implementation, and the inability to fulfill a legal obligation.

Duration of Personal Data processing

The period of storage of Personal Data depends on the purpose for which the Personal Data are processed, the compliance of the Personal Data with the purposes, their correctness, the exercise of the rights by the Person to whom the Personal Data relates and the current legal regulations.

Personal Data processed on the basis of the Consent may be processed until the Consent is withdrawn or the Service is provided.

In the event of contact in order to provide a Person with information about the Services and the rules of operation of ajConsulting, the Personal Data of the Person is processed until such Person submits an objection.

Categories of Personal Data

The categories to which Personal Data are subject depend on the purpose for which they are processed, the law and the Person who provides them.

Personal Data processed on the basis of the Consent may include the following categories: Name and surname, Contact details, Location, Education, Work experience, Certificates, Competences, References, Recruitment expectations, Professional preferences, or go beyond these categories, depending on the scope Personal Data provided by the Person.

Special categories of Personal Data

The Administrator may not process or conduct activities that require the processing of specific data, also known as sensitive data, related to health, genetics, biometrics, sexuality or sexual orientation, racial or ethnic origin, political views, religious or philosophical beliefs, membership of trade unions or criminal record.

The Person who provides their Personal Data should not declare specific data if they require their Personal Data to be processed by the Administrator.

Categories of recipients of Personal Data

The Administrator may transfer the Personal Data of a Person to a recipient who is:

  • A Client for whom ajConsulting provides the Services under the Agreement
  • A Candidate who uses the Services of ajConsulting
  • An Associate of ajConsulting
  • A Provider who carries out services for ajConsulting
  • An Entity authorized by law

Transfer of Personal Data

Personal Data may be transferred to selected recipients depending on the purpose for which they are processed and the law.

Personal Data processed for the purpose of the Service or the performance of the Agreement may be transferred to the parties for whom the Service is performed on the basis of the consent to the transfer.

Personal Data may be transferred to a third country or an international organisation only on the basis of the Consent and prior notification of the Person giving their consent and on the existence or absence of an adequacy decision by the Commission or about appropriate safeguards and the means to obtain a copy of the data or where the data have been made available.

Personal data is processed within the European Economic Area (EEA).

Automated decision making

The Administrator does not make decisions using automated means and does not profile Personal Data in an automated manner.

Profiling

The Administrator undertakes a comprehensive assessment of the Personal Data of the Person for whom the Service is provided, in order to best perform the Service for that Person.
